Woman Sues Employer Over Gender-Based Pay Discrimination

EqualPay3

The gender pay gap is well known.  Women get paid less than men of similar professional background in exchange for the same work.  Comedians of both sexes make jokes about it, and some people even commemorate the day each year by which women’s pay catches up to the amount that men earned by the end of the last year.  The percentage of women in highly skilled and highly paid positions of employment has certainly increased over the past few decades, and while this is encouraging, it is not relevant to your employment discrimination claim.  If you are alleging sex discrimination and citing unequal pay as evidence, then what matters is not whether you get paid as much as any of the male employees in your organization, but whether you get paid as much as the male employees whose position title and job duties are the same as yours.  To find out more about how the law protects employees against sex discrimination, contact a Los Angeles discrimination and harassment lawyer.

Female Engineer Claims That She Receives Lower Pay Than Men in a Similar Role at Her Company

The plaintiff in a current lawsuit in California works as an engineer for a large technology company; she is one of a small number of female engineers employed by the company.  When she was hired several years ago, the employer offered her a starting salary of $92,000.  Later, when the California Pay Transparency Act went into effect, she found out that men who had been hired at the same company in the same role at around the same time had received a starting salary of $115,000.  In other words, the plaintiff’s starting salary was $23,000 less than those of her male colleagues who performed the same work; the plaintiff got paid only 80 percent of what men in the same role got paid.  Unfortunately, this pay gap is common across many industries.

In October 2023, she filed a lawsuit against the employer, alleging sex discrimination.  Her claim is part of a class action lawsuit against the employer, which also alleges racial discrimination against many employees.

Where to Begin With a Discrimination Claim

It is never too soon to meet with an employment discrimination lawyer if you are experiencing discrimination at work, whether the discrimination takes the form of harassment, inadequate and unequal pay, or unjustified adverse actions, among other possible manifestations of discrimination.  Contacting the Equal Employment Opportunity Commission (EEOC) to initiate a preliminary investigation and get approval to move forward with your case is a prerequisite to filing an employment discrimination lawsuit in court.  The sooner you contact a lawyer, the greater the chances of your claim being successful.
