Religious Discrimination vs. Religious Harassment

Religious discrimination focuses on the disparate treatment an employee endures because of their beliefs, meaning the employee was treated differently and unfairly because of their religion. 

An employee may also experience religious harassment if the employee is subjected to hostile, intimidating, offensive, oppressive, or abusive conduct that is severe or pervasive based on the employee’s religious beliefs. 

What To Do If You Experience Religious Discrimination at Work

An employee who experiences religious discrimination or harassment at work has the option to file a formal complaint in writing with the employer or HR. 

Employees may also file a complaint with the California Civil Rights Department (CRD), or a charge for discrimination with the United States Equal Employment Opportunity Commission.

    What religious accommodations are employers required to provide in California?

    Employers are required to reasonably accommodate the religious beliefs, observances, and practices of employees unless it would impose an undue hardship on the conduct of the employer’s business. 

    The determination of the reasonable accommodations should be made through the interactive process. Employees have a right to ask for reasonable accommodations to initiate the interactive process.

    I’m still being discriminated against or harassed after complaining

    Employers have an obligation to prevent religious discrimination or harassment by taking all reasonable steps necessary. This may include implementing policies or training and enforcing those policies.

    How long do I have to file a religious discrimination claim?

    The time limit varies depending on the employer and claims. It can be as short as six months for public entity employers, or 180 days to file a charge with the EEOC for claims under federal law. A complaint with the CRD in California must be filed within three years and prior to filing a lawsuit.

    Can I be fired for requesting religious accommodation?

    No. This type of conduct is considered retaliation, and it is illegal for an employer to terminate an employee for requesting reasonable accommodations.
