What are punitive or exemplary damages?

Civil Code section 3294 defines punitive damages as a monetary award “for the sake of example” and to punish the wrongdoer for intentional oppression, fraud, or malice. These are damages awarded on top of, or even absent, actual damages, and the amount is based upon the financial condition of the wrongdoer because the same amount won’t punish a wealthy wrongdoer as much as an insolvent one. The right to exemplary damages are difficult to prove, because it must be shown by clear and convincing evidence. They are also only available in claims for a breach of an obligation not arising out of contract, which is why many people sue for various torts (like fraud), when there is a breach of contract. The judges know, though, that this is a litigation tactic, and an experienced litigation attorney ensures that actionable torts recognized by the courts exist prior to filing suit.
